InspectEquip™ ("the App") is a software application operated by Vortech Mechanical Services Pty Ltd (ACN 655 628 050), an Australian registered company.
InspectEquip is a digital recording, documentation, and reporting tool only. The App does not provide mechanical, engineering, legal, compliance, safety, or other professional advice.
For the purposes of this Disclaimer, "reports" include inspection reports, condition reports (such as pre-start, pre-hire, return and handover inspections), service reports, breakdown reports, repair reports, and other report types or workflows that may be introduced in future versions of the App.
All reports, checklists, templates, records, photographs, signatures, and other outputs generated using the App are provided for informational and record-keeping purposes only.
Users must not rely on the App or any output generated by the App as a substitute for independent professional judgment, inspection, assessment, testing, verification, certification, or approval. Use of the App is at the user's sole risk.
The App does not:
Any templates, checklists, prompts, item lists, or sample content provided within InspectEquip are general reference tools only and are provided for convenience.
They may not reflect:
Users are solely responsible for determining whether any template, checklist, prompt, or item list is suitable for their intended purpose and for adding, removing, modifying, or independently verifying items as required.
Vortech Mechanical Services Pty Ltd does not accept responsibility for items that are omitted, incomplete, unchecked, inaccurate, unsuitable, or not included within the App or any template.
All observations, checklist responses, notes, comments, photographs, signatures, service details, breakdown findings, repair details, conclusions, recommendations, and reports created using InspectEquip are based entirely on information entered, selected, or recorded by the user.
Users remain fully and solely responsible for:
InspectEquip and Vortech Mechanical Services Pty Ltd do not independently inspect, monitor, test, verify, validate, certify, or approve any asset, condition, defect, work performed, finding, conclusion, recommendation, signature, or user-entered information.
Reports generated by the App reflect only the information recorded by the user at the relevant time. Conditions may change after a report is completed.
Reports, checklists, and records generated by the App do not constitute:
unless independently reviewed and certified by a suitably qualified and authorised person where required.
A signature recorded through the App confirms only that the person signed or acknowledged the relevant report. It does not independently verify the accuracy, completeness, quality, safety, compliance, or legal effect of the report or any work performed.
No report generated by the App should be interpreted as a guarantee, warranty, representation, or certification of present or future condition, safety, compliance, reliability, serviceability, or fitness for purpose.
Customer, vehicle, asset, and report data is primarily stored locally on the user's device and/or within storage services selected, configured, or controlled by the user.
The App may use limited third-party services for functions such as subscription or licence verification, device registration, recovery email verification, diagnostics, infrastructure, and support.
The App may allow users to export and import customer, vehicle, asset, and report data. Exported files are created locally on devices or storage systems controlled by the user.
We do not guarantee uninterrupted access, error-free operation, continued availability, compatibility, or the accuracy, completeness, security, integrity, preservation, transferability, or recoverability of any data stored, entered, imported, exported, displayed, or generated through the App.
To the maximum extent permitted by law, we are not responsible for:
Users are solely responsible for maintaining adequate backups, protecting their devices and files, checking transferred or restored data, and preserving required business and operational records.
To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis without warranties, guarantees, representations, or conditions of any kind, whether express, implied, statutory, or otherwise.
We do not warrant that the App will meet every user's requirements, be suitable for any particular purpose, identify every issue or defect, produce complete or accurate outcomes, or operate without interruption, delay, incompatibility, error, or defect.
To the maximum extent permitted by law, Vortech Mechanical Services Pty Ltd excludes liability for any loss, damage, cost, expense, claim, injury, defect, failure, or consequence arising out of or in connection with:
Where liability cannot lawfully be excluded, our liability is limited to the maximum extent permitted by law.
To the extent permitted by law, our total aggregate liability arising out of or in connection with the App is limited to the amount paid by the user for use of the App in the 12 months immediately preceding the event giving rise to the claim.
Nothing in this Disclaimer excludes, restricts, or modifies any right, guarantee, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law.
By downloading, installing, accessing, or using InspectEquip, the user acknowledges and accepts this Disclaimer.
