InspectEquip Terms of Use

InspectEquip™ ("the App") is a software application operated by Vortech Mechanical Services Pty Ltd (ACN 655 628 050), an Australian registered company ("we", "our", or "us").

By downloading, accessing, installing, or using InspectEquip, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you must not use the App.

For the purposes of these Terms, "reports" include inspection reports, condition reports (such as pre-start, pre-hire, return and handover inspections), service reports, breakdown reports, repair reports, and other report types or workflows that may be introduced in future versions of the App.

1. Use of the App

InspectEquip is provided as a digital tool to assist with recording, documenting, and reporting information relating to vehicles, machinery, equipment, assets, inspections, condition assessments, servicing, breakdowns, repairs, and related operational activities.

The App does not provide mechanical, engineering, legal, compliance, safety, or other professional advice.

Any templates, checklists, prompts, item lists, or sample content provided within the App are general reference tools only. They are supplied for convenience and may not reflect manufacturer procedures, site-specific safety requirements, regulatory standards, contractual requirements, or industry best practices.

The App does not replace:

You remain fully and solely responsible for all decisions, actions, findings, conclusions, and outcomes associated with your use of the App.

You must not rely on the App or any report, checklist, template, record, or output generated by the App as a substitute for independent professional judgment, inspection, assessment, testing, or verification.

Use of the App is at your sole risk.

2. Professional Responsibility

All results, observations, notes, comments, checklist responses, photographs, signatures, reports, findings, and conclusions created using the App are the sole responsibility of the user.

Vortech Mechanical Services Pty Ltd does not inspect, review, verify, certify, validate, or approve user input, work performed, findings, outcomes, or user-generated reports.

3. Informational Nature of Reports

All reports, checklists, records, and other outputs generated by the App are provided for informational and record-keeping purposes only.

They reflect observations and information recorded by the user at the relevant time and may not represent the condition, safety, compliance, or operation of a vehicle, machine, item of equipment, or asset at any later time.

Reports generated by the App do not constitute engineering certification, roadworthiness approval, safety certification, regulatory authorisation, compliance certification, or any other legally binding certification or formal professional report unless independently reviewed and certified by an appropriately qualified and authorised person where required.

A signature recorded through the App confirms only that the person signed the relevant report or acknowledgement. It does not independently verify the accuracy, completeness, quality, safety, or legal effect of the report or work performed.

4. User Data and Storage Responsibility

Customer, vehicle, asset, and report data is primarily stored locally on the user's device and/or within storage services selected, configured, or controlled by the user.

Limited subscription, licence verification, device registration, recovery email verification, diagnostic, and support-related information may be processed using third-party services required for App functionality.

The App may allow users to export and import customer, vehicle, asset, and report data for backup or device transfer purposes. Exported files are created locally on devices or storage systems controlled by the user and are not routinely uploaded to or stored by Vortech Mechanical Services Pty Ltd.

You are solely responsible for:

We do not guarantee the accuracy, completeness, integrity, availability, preservation, compatibility, transferability, or recoverability of any data stored, entered, imported, exported, displayed, or generated by the App.

To the maximum extent permitted by law, we are not responsible for data loss, corruption, deletion, duplication, incomplete transfers, device failure, interrupted access, software malfunction, or issues arising from third-party platforms, storage services, infrastructure, operating systems, or devices.

5. Acceptable Use

You agree not to:

We may suspend, restrict, or terminate access to the App if we reasonably suspect misuse, breach of these Terms, unlawful conduct, interference with App security or licensing, or conduct that may expose us or others to risk.

6. Subscriptions, Licences, and Device Access

Certain features of InspectEquip may require a paid subscription or valid licence.

InspectEquip uses a licence-based access system rather than user accounts. Access to subscription features may depend on a valid licence key, device registration, applicable device limits, subscription status, and periodic entitlement verification.

Where a free trial is offered, the subscription may automatically convert to a paid subscription at the end of the trial period unless cancelled beforehand.

Subscriptions may automatically renew unless cancelled in accordance with the terms of the Apple App Store or Google Play Store, as applicable.

Subscription purchases, billing, renewals, cancellations, and eligible refunds are handled through the relevant app store account and are subject to that app store's terms, policies, and processes, together with any rights that apply under applicable law.

Restore Purchases is available only within the same app store ecosystem as the original purchase. Google Play purchases may only be restored on supported Android devices using the relevant Google Play account. Apple App Store purchases may only be restored on supported Apple devices using the relevant Apple ID.

Cross-platform restoration is not supported. If you move from Android to Apple, or from Apple to Android, you may need to cancel your existing subscription through the original app store and subscribe again through the new platform.

We may limit the number of devices that can be registered to a subscription. You are responsible for protecting your licence key and managing access to registered devices.

Access to subscription features may remain available for a limited period while the App is offline, based on the most recent successful entitlement verification. Offline access is temporary and subject to expiration.

The App may periodically require an internet connection to verify subscription status and maintain or restore access. Failure to complete verification within the required period may result in restricted access to subscription features until verification is completed.

7. Recovery Email and Access Recovery

You may be able to nominate a recovery email address for subscription recovery and management of registered devices.

By providing a recovery email address, you confirm that you are authorised to use it and consent to it being used to:

Recovery email addresses are not used for marketing or promotional communications.

Sensitive actions may include recovering access, transferring manager access, replacing or removing registered devices, or restoring subscription access on a device.

Where your subscription device limit is reached, recovery email verification may be required before access can be moved to another device. Completing recovery may replace, remove, or restrict access for previously registered devices.

You are responsible for ensuring that your recovery email address remains accurate, secure, and accessible.

8. Feedback and Support

If you contact us through an in-app feedback or support form, you may provide your name, email address, message content, and optional subscription, device, or technical information.

You acknowledge that support and feedback submissions may be transmitted and processed using third-party service providers for delivery, infrastructure, diagnostic, and support-handling purposes.

You must not submit unlawful, defamatory, infringing, misleading, malicious, harmful, or inappropriate content through support or feedback channels.

We do not guarantee that support will be available at all times or that every request, issue, feature suggestion, or enquiry will be resolved or implemented.

9. Intellectual Property

The App, including its software, functionality, design, branding, text, graphics, logos, layout, templates, and other content, is owned by or licensed to Vortech Mechanical Services Pty Ltd and is protected by applicable intellectual property laws.

Except as expressly permitted by law or by us in writing, no part of the App may be copied, reproduced, distributed, modified, published, licensed, sold, commercially exploited, or used to create a competing product or service.

You retain responsibility for content and information you enter into the App. You must ensure that you have the necessary rights, permissions, and authority to use, record, store, export, and share that content.

10. App Availability and Updates

We may modify, update, suspend, restrict, or discontinue any part of the App at any time, with or without notice, subject to applicable law.

We do not guarantee that the App will always be available, uninterrupted, secure, compatible, or error-free, or that every defect will be corrected.

We may release updates, patches, fixes, or upgrades from time to time. Features, templates, workflows, technical requirements, and supported operating system versions may change or be removed.

You are responsible for installing updates and using a supported device and operating system where required for continued access to the App.

11. No Warranties

To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis without warranties, guarantees, representations, or conditions of any kind, whether express, implied, statutory, or otherwise.

We do not warrant that the App will meet your requirements, be suitable for any particular purpose, produce complete or accurate outcomes, identify every issue or defect, or operate without interruption, delay, error, incompatibility, or defect.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Vortech Mechanical Services Pty Ltd excludes liability for indirect, incidental, special, consequential, exemplary, business, commercial, financial, mechanical, operational, regulatory, safety-related, or loss-of-profit damages arising out of or in connection with:

To the extent permitted by law, our total aggregate liability arising out of or in connection with the App or these Terms is limited to the amount paid by you for use of the App in the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded or limited under applicable law, including the Australian Consumer Law.

13. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold harmless Vortech Mechanical Services Pty Ltd and its directors, officers, employees, contractors, and affiliates from and against claims, demands, actions, liabilities, damages, losses, costs, and expenses, including reasonable legal costs, arising out of or in connection with:

This indemnity does not apply to the extent that a claim, loss, or liability was directly caused by our unlawful conduct, negligence, or breach of a non-excludable obligation.

14. Changes to These Terms

We may update these Terms from time to time.

The updated version will take effect when made available through the App, our website, or another reasonable method of notice.

Where acceptance of an updated version is required, access to the App may be restricted until you review and accept the updated Terms.

Your continued use of the App after the updated Terms take effect constitutes acceptance of the revised Terms.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia.

To the extent permitted by law, you submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts entitled to hear appeals from them.
